Terms of Service

These Terms govern your access to and use of ParkHandy, including HotSwap, Space Rental, host services, parking transactions, and related features.

Effective Date: August 24, 2026

1. Agreement to These Terms

These Terms of Service are a legal agreement between you and Parkhandy LLC governing your use of the ParkHandy mobile application, website, and related services.

By accessing or using ParkHandy, you agree to these Terms and to any policies incorporated into them by reference, including the ParkHandy Privacy Policy.

If you do not agree to these Terms, you must not use ParkHandy.

2. About ParkHandy

ParkHandy is a technology platform that helps users locate, coordinate, reserve, offer, and manage parking opportunities. Features may include HotSwap, Space Rental, host tools, navigation-related functionality, notifications, ratings, reviews, and support services.

Parkhandy LLC provides the technology platform and related services. Except where expressly stated otherwise, Parkhandy LLC does not own, operate, manage, inspect, supervise, or guarantee individual parking spaces offered by users.

3. Eligibility and Accounts

You must be legally capable of entering into a binding agreement and must satisfy any age or other eligibility requirements applicable to the ParkHandy service you use.

You are responsible for providing accurate account information and for keeping your sign-in credentials secure. You are responsible for activity occurring through your account unless prohibited by law.

You must promptly notify ParkHandy if you believe your account has been accessed or used without authorization.

4. HotSwap

HotSwap is designed to help connect a user who expects to leave a parking location with a user seeking nearby parking. HotSwap may use location information, proximity, navigation, notifications, and transaction status to coordinate the parking handoff.

A HotSwap does not transfer ownership or legal control of a public roadway, curb, municipal parking location, or other property. Users remain responsible for complying with all parking restrictions, traffic laws, signs, meters, permit requirements, time limits, and other applicable rules.

ParkHandy does not guarantee that a parking space will remain available, that another driver will not occupy it, or that a HotSwap can be completed successfully.

Users must never block traffic, stop unlawfully, drive dangerously, confront another driver, or engage in unsafe conduct in order to complete a HotSwap.

5. Space Rental

Space Rental allows eligible hosts to offer parking spaces and allows renters to request or reserve those spaces for specified periods.

Rental availability, duration, pricing, booking status, and other terms may vary depending on the listing and the transaction.

A renter receives only the temporary parking permission associated with the confirmed rental. A rental does not create a leasehold interest, tenancy, ownership interest, or any other property right except to the extent required by applicable law.

6. Host Responsibilities

By listing a parking space, a host represents that the host has the legal right and authority to offer that space for parking and that doing so does not violate any applicable law, lease, deed restriction, condominium or homeowners association rule, municipal rule, permit requirement, or other binding obligation.

Hosts are responsible for maintaining accurate information regarding the location, type, size, access, availability, and restrictions associated with a listed space.

Hosts must not knowingly offer a space that is unsafe, inaccessible, unlawfully offered, materially misrepresented, or unsuitable for the vehicle or use represented in the listing.

Hosts are responsible for honoring confirmed bookings unless cancellation or other action is permitted under the ParkHandy rules applicable to the transaction.

7. Renter Responsibilities

Renters are responsible for reviewing the information associated with a parking space and determining whether the space is appropriate for their vehicle and intended use.

Renters must park only during the confirmed rental period and must follow reasonable access instructions and applicable parking restrictions.

Renters must not damage property, obstruct access, create a nuisance, use a parking space for unlawful activity, or remain beyond the authorized rental period without an approved extension or other permission.

8. Vehicle Information

Users may be required to provide vehicle information in connection with a HotSwap or Space Rental transaction.

You are responsible for ensuring that vehicle information you provide is accurate and corresponds to the vehicle being used for the relevant parking transaction.

9. Prices, Charges, and Payments

Certain ParkHandy services may require payment. Applicable prices, fees, charges, taxes, or other amounts may be presented before a user completes a transaction.

ParkHandy may use third-party payment service providers to process charges, payouts, refunds, and related financial transactions.

By initiating a paid transaction, you authorize the applicable charges and agree to provide valid payment information through the available payment process.

Parkhandy LLC may correct pricing or transaction errors when reasonably necessary and as permitted by law.

10. Host Payouts

Host earnings may be subject to applicable ParkHandy fees, transaction adjustments, refunds, disputes, reversals, payment processor requirements, taxes, or other authorized deductions.

Timing of host payouts may depend on transaction completion, payment processing, fraud review, dispute status, and other operational requirements.

11. Cancellations, Refunds, and Adjustments

Cancellation and refund eligibility may depend on the type of transaction, timing, circumstances, and ParkHandy rules in effect for that service.

ParkHandy may issue, deny, reduce, reverse, or adjust a refund, credit, charge, or payout when reasonably necessary to address a cancellation, failed transaction, duplicate payment, dispute, misuse, error, safety issue, or other transaction problem.

12. Rental Extensions

A renter may request an extension where the feature is available. An extension is not effective unless it is approved and confirmed through ParkHandy.

Extensions may be unavailable when the parking space has a conflicting booking, is no longer available, or cannot be extended for another operational or legal reason.

13. Ratings, Reviews, and Comments

ParkHandy may allow users to rate or review another user or a parking transaction.

Ratings, reviews, and comments must reflect genuine experiences and must not contain knowingly false statements, threats, harassment, discriminatory content, unlawful material, or other prohibited content.

ParkHandy may remove, restrict, or decline to display content that violates these Terms, applicable law, or platform policies.

14. Reports, Problems, and Disputes

ParkHandy may provide tools that allow users to report a problem, submit evidence, start a dispute, or request review of a parking transaction.

A case or dispute may be assigned a Case ID and may include transaction history, user communications, photographs, payment information, status changes, refunds, payouts, and other records relevant to the matter.

Users must provide truthful information during a report or dispute process and must not knowingly submit fabricated, altered, misleading, or fraudulent evidence.

ParkHandy may make reasonable administrative decisions concerning transactions, refunds, payouts, account status, and platform access based on the information available.

15. Location and Navigation

ParkHandy may provide location, mapping, distance, route, or navigation-related features through ParkHandy or third-party services.

Mapping, location, traffic, route, distance, and navigation information may be inaccurate, delayed, unavailable, or affected by conditions outside ParkHandy's control.

Users are responsible for driving safely, obeying traffic laws, and relying on actual road conditions, signs, and lawful instructions rather than any application display.

Never interact with ParkHandy in a way that distracts you while operating a vehicle.

16. Safety

Users are responsible for exercising reasonable care during all parking activity and interactions with other users.

ParkHandy does not guarantee the identity, conduct, reliability, driving behavior, property condition, or safety of another user or parking location.

If a situation appears unsafe or unlawful, do not proceed with the parking transaction.

17. Prohibited Conduct

You may not use ParkHandy to:

  • violate any law, regulation, parking rule, or traffic law;
  • misrepresent your identity, vehicle, parking space, or transaction;
  • offer property you do not have authority to offer;
  • submit fraudulent bookings, payments, refunds, disputes, or evidence;
  • harass, threaten, intimidate, discriminate against, or harm another person;
  • interfere with or manipulate ratings, reviews, bookings, pricing, or availability;
  • circumvent payment obligations or platform safeguards;
  • damage, disable, reverse engineer, disrupt, or improperly access ParkHandy systems;
  • use automated systems to scrape, copy, overload, or misuse ParkHandy;
  • upload malicious software or harmful content; or
  • use ParkHandy for fraudulent, deceptive, dangerous, or unlawful purposes.

18. Notifications and Communications

ParkHandy may send notifications or other communications relating to bookings, requests, payments, HotSwap activity, rental status, disputes, account security, and other service matters.

Users are responsible for maintaining current contact information and appropriate notification settings when those communications are necessary for active transactions.

19. Third-Party Services

ParkHandy may rely on or interact with third-party services, including mapping providers, navigation providers, payment processors, authentication providers, cloud providers, communication providers, app stores, and other technology services.

Those third parties may have separate terms, policies, and requirements. Parkhandy LLC is not responsible for the acts, omissions, outages, errors, or independent services of third parties except to the extent required by law.

20. Intellectual Property

ParkHandy, including its software, branding, designs, graphics, logos, text, features, and related intellectual property, is owned by or licensed to Parkhandy LLC and is protected by applicable intellectual property laws.

These Terms give you a limited, revocable, non-exclusive, non-transferable right to use ParkHandy for its intended purposes. No ownership rights are transferred to you.

21. User Content

You retain whatever ownership rights you may have in content you submit to ParkHandy.

By submitting content necessary to operate ParkHandy, you grant Parkhandy LLC a non-exclusive license to host, store, reproduce, process, display, and use that content as reasonably necessary to provide, administer, protect, and improve the service and to address transactions or disputes.

You represent that you have the rights necessary to submit the content you provide.

22. Suspension and Termination

Parkhandy LLC may restrict, suspend, or terminate access to ParkHandy when reasonably necessary to address violations of these Terms, fraud, misuse, security concerns, unlawful activity, risk to users, payment issues, repeated disputes, or other material platform concerns.

Where appropriate, ParkHandy may investigate or provide an opportunity to resolve an issue before taking final action, but immediate action may be taken when necessary for safety, security, legal compliance, or fraud prevention.

23. Service Availability

ParkHandy may change, update, suspend, limit, or discontinue features or services from time to time.

We do not guarantee uninterrupted or error-free operation, continuous availability of parking opportunities, or that all functions will be available in every location or on every device.

24. Disclaimer of Warranties

To the fullest extent permitted by applicable law, ParkHandy is provided on an "as is" and "as available" basis.

Parkhandy LLC does not make warranties regarding the availability of a particular parking space, the conduct of a user, the condition or legality of a parking location, the accuracy of third-party information, or the uninterrupted operation of the service.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

25. Limitation of Liability

To the fullest extent permitted by applicable law, Parkhandy LLC and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of ParkHandy.

This may include loss arising from unavailable parking, towing, tickets, vehicle damage, property damage, user conduct, missed transactions, lost profits, lost data, or service interruptions, except where liability cannot legally be limited.

Any limitation of liability will apply only to the extent permitted by applicable law.

26. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Parkhandy LLC and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, costs, and expenses arising from your unlawful conduct, your violation of these Terms, your misuse of ParkHandy, or your infringement of another person's rights.

27. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where applicable law requires otherwise.

28. Dispute Resolution and Venue

Before filing a formal legal claim relating to ParkHandy, we encourage users to contact Parkhandy LLC so the matter can first be reviewed and, where appropriate, resolved.

Unless applicable law requires otherwise or a separate enforceable dispute-resolution agreement applies, legal proceedings arising from these Terms may be brought in a court of competent jurisdiction in New Jersey.

29. Changes to These Terms

Parkhandy LLC may update these Terms from time to time to reflect changes to ParkHandy, our business practices, technology, legal requirements, or platform rules.

When these Terms are updated, we may revise the effective date displayed on this page. Where required by law, we will provide additional notice or obtain consent.

30. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

31. Entire Agreement

These Terms, together with policies and additional terms expressly incorporated by reference, constitute the agreement between you and Parkhandy LLC concerning your use of ParkHandy, except where a separate written agreement applies.
